&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;This is a blog series designed to walk you through the mechanics of a contested divorce. It will allow you to understand what to expect and what you need to prepare. This blog will discuss what to expect AFTER the commencement of the Divorce when the Petition and Response has been competed, filed, and served.&lt;/span&gt;&lt;/p&gt;

&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;&lt;/span&gt;&lt;span style="font-size: 18px;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The Financial Disclosures: Non-Negotiable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Early in the case, both spouses must exchange a package of sworn financial documents called the Preliminary Declaration of Disclosure. &lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=FAM&amp;amp;sectionNum=2104."&gt;&lt;u&gt;&lt;span&gt;Family Code section 2104&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; makes this mandatory, and cannot be waived.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The law requires the Petitioner to serve a Preliminary Declaration of Disclosure within 60 days of filing the petition. The Respondent must file their declaration within 60 days of filing their response. If either party fails to comply the consequences can be severe as set for in &lt;/span&gt;&lt;a href="https://california.public.law/codes/family_code_section_2107"&gt;&lt;u&gt;&lt;span&gt;Cal. Fam. Code §2107.&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; The consequences can include:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;1. Financial and Asset Penalties&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Asset Forfeiture:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; The court can award up to 100% of the value of an undisclosed asset or obligation to the innocent spouse (&lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?sectionNum=1101.&amp;amp;lawCode=FAM"&gt;&lt;u&gt;&lt;span&gt;Family Code Section 1101(g&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;)). &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Judgment Set-Aside:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; A previous divorce settlement or court judgment can be completely canceled (set aside) due to fraud or failure to disclose material financial facts. &lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;2. Sanctions and Fees&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Attorney Fees:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; The offending party is routinely ordered to pay the other side's lawyer and court costs required to track down the missing financial information. [&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Monetary Sanctions:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Judges can impose heavy cash fines as a penalty for wasting the court's time and violating disclosure laws, regardless of whether the non-disclosure was intentional or negligent. &lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;3. Legal and Criminal Consequences&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Perjury Charges:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Disclosures are signed under penalty of perjury; knowingly lying or hiding assets can lead to criminal perjury or fraud charges. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Contempt of Court:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Disobeying court orders to produce financial documents can result in a contempt citation, carrying potential fines or jail.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The bottom line is you &lt;/span&gt;&lt;strong&gt;&lt;span&gt;MUST&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; comply! The financial disclosure package that must be sent to your spouse includes:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span&gt;The &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl140.pdf"&gt;&lt;u&gt;&lt;span&gt;Declaration of Disclosure (FL-140),&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;A &lt;/span&gt;&lt;a href="https://courts.ca.gov/system/files?file=2025-07/fl142.pdf"&gt;&lt;u&gt;&lt;span&gt;Schedule of Assets and Debts (FL-142),&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;An &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl150.pdf"&gt;&lt;u&gt;&lt;span&gt;Income and Expense Declaration (FL-150),&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Statement of Material Facts&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt; and your last two years of tax returns. &lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;You also must file with the court your sworn statement confirming you served the disclosures which is &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl141.pdf"&gt;&lt;u&gt;&lt;span&gt;Form FL-141.&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Be thorough and be honest, getting caught even shading your disclosures poisons everything that follows.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Temporary Orders: The Case Inside the Case&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;By their very nature contested divorces can last from one to two or more years and during that period both parties must continue on with their lives paying their bills, mortgage, and caring for children. To allow life to continue, either party can file motions with the Court to request temporary orders regarding child custody, child support, spousal support, control of property, or attorney fee contributions while the case is pending. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;These temporary orders are usually filed within the first few months of the original filing, but can be filed anytime during the case. While these are designated as “temporary orders” you should take great care in making sure that the order works for you in the long term as they often form the framework for the final judgement.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;To make a request of the Court, you must use &lt;/span&gt;&lt;a href="https://courts.ca.gov/system/files?file=2025-07/fl300.pdf"&gt;&lt;u&gt;&lt;span&gt;Request for Order (Form FL-300).&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Discovery: Gathering the Facts&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;Discovery is a time consuming and formal information-gathering phase designed to allow each party to ensure transparency, and gather information and evidence to prepare for settlement negotiations or trial. The process of discovery can involve take several different methods, such as:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li style="color: #242b2e;"&gt;&lt;strong&gt;&lt;span&gt;Form Interrogatories–Family Law (&lt;/span&gt;&lt;/strong&gt;&lt;a href="https://courts.ca.gov/system/files?file=2025-07/fl145.pdf"&gt;&lt;u&gt;&lt;span&gt;FL-145). &lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;In California family law, there is an official form used for standard written questions covering basic financial and marital background questions.&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #242b2e;"&gt;&lt;strong&gt;&lt;span style="color: #242b2e;"&gt;Special Interrogatories:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #242b2e; white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;span&gt;These are custom-written questions used to get facts unique to your case that, target specific financial contentions, and lock down the other side's sworn claims in a divorce or custody suit. Unless you attach a special declaration for additional discovery, California law restricts you to 35 special interrogatory questions that cannot be compound or contain subpart questions (e.g. a, b. c)&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #242b2e;"&gt;&lt;strong&gt;&lt;span style="color: #242b2e;"&gt;Request for Production (RFPs):&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #242b2e;"&gt; Is the process that allows you to ask the opposing side &lt;/span&gt;&lt;span style="color: #1b1b1b; background-color: #ffffff;"&gt;to produce and allow copying or inspection of a document or thing. &lt;/span&gt;&lt;span style="color: #242b2e;"&gt;Typically, this may include documents such as bank statements, tax returns, pay stubs, deeds, insurance policies, and any other financial records that shed light on assets, debts, and income. Electronically stored information, such as emails and text messages, can also be requested. Since there is no special form for this type of request, standard pleading format is used.&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #242b2e;"&gt;&lt;strong&gt;&lt;span style="color: #242b2e;"&gt;Requests for Admission (RFAs):&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #242b2e; white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;span&gt;Requests for Admissions in a family law case are used to have the other party admit the truth of specific facts or the genuineness of documents so they do not need to be proven at trial. It is often used as a method to authenticate documents, establish property status, or to narrow the issues at trial. These admissions are obtained by drafting a formal written demand and waiting for a sworn response. &lt;/span&gt;&lt;span style="color: #242b2e;"&gt;Since there is no special form for this type of request, standard pleading format is used.&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #242b2e;"&gt;&lt;strong&gt;&lt;span style="color: #242b2e;"&gt;Depositions:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #242b2e; white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;span&gt;A deposition in a California family court divorce is an out-of-court proceeding where a lawyer asks a spouse or witness questions under oath, limited generally to 7 hours of total testimony, and recorded by a court reporter and may be videotaped. The deposition process requires a formal notice to be served on the party or third party witness to be deposed. If that person is not a party in the proceedings it will require a subpoena to secure their attendance. The scope of the questions can be wide-ranging covering financial matters, child custody and care practices, and general background questions. Depositions are generally used to lock in a party’s testimony, to impeach the testimony of a witness, or evaluate a witness for credibility or settlement leverage.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;How heavy and involved discovery gets depends on what's disputed. A case fighting over a parenting schedule may need little discovery. However, a case involving a family business, stock compensation, or suspicions of hidden income can involve forensic accountants and months of document exchange. This phase is also where legal fees climb fastest, which creates its own pressure to settle.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Settlement Conferences&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;Once the discovery process is complete, the Los Angeles County family courts hold a Mandatory Settlement Conference (MSC). As the name suggests, this conference MUST be attended by both parties and, if represented, by their attorneys. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;Before the settlement conference, both parties prepare and serve a formal settlement conference brief outlining contested and uncontested issues, asset/debt proposals, and support calculations in compliance with local rules. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;If forensic accountants or financial experts are utilized, they are often required to meet and confer beforehand to attach a joint statement or side-by-side analysis to the MSC brief.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;The overwhelming majority of contested divorces settle before trial.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Trial&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;Family law divorce trials in Los Angeles County are formal, structured court proceedings where a judge hears testimony, reviews financial evidence, and makes final binding decisions on unresolved issues like property division, child custody, and support. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;Procedurally each side gives opening statements, calls witnesses (including forensic accountants or custody evaluators), and cross-examines the other witnesses and spouse.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;This is one of the most difficult phases for a party to perform without counsel because parties must follow formal rules of evidence and understand how to admit a document or photo into evidence&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;After each side presents their case and witness testimonies are given, the judge will either state their decision on the record but more often the Judge will take the case under submission and later mail their written decision weeks later.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;One more aspect worth noting: if the case drags but you need to be legally single sooner (to remarry, or for tax reasons), &lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=FAM&amp;amp;sectionNum=2337."&gt;&lt;u&gt;&lt;span&gt;Family Code section 2337&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; lets the court sever, or "bifurcate," marital status and end the marriage while property and other issues stay in litigation.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;The Trial Phase is Over&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;While this summary of how to prepare and conduct a trial in the Los Angeles County Family Courts may seem quite expansive, it really is just a brief overview. When child custody issues are involved, the process will take on even more complexity. Our final blog in this series will discuss that aspect.&lt;/span&gt;&lt;/p&gt;

&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;This is especially true because most people who walk into the Stanley Mosk Courthouse for the first time know almost nothing about how a divorce process works and how it moves through the system. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Your feelings are completely normal; nobody plans for this, and the process has its own vocabulary, deadlines, and rhythm that can feel designed to confuse you.&lt;/span&gt;&lt;/p&gt;

&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A contested divorce isn't a special category of case you file. In fact, most law dictionaries don't include the term. It is when the parties to a divorce disagree on at least one issue and it requires the court to resolve. It can involve a factual issue such as the value of property, a legal issue such as custody or spousal support, or a situation where either party is simply unreasonable and refuses to settle the issues.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Contested cases follow the same filing steps as uncontested cases but add discovery, court hearings, settlement conferences, and potentially a trial. A contested divorce can take years to resolve depending on the complexity of the issues, the court’s caseload, and the degree of cooperation between the parties.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The disagreement doesn't have to be hostile. Two reasonable people can look at the same pension and honestly disagree about what it's worth. But once there's a dispute a judge must decide, you're in contested divorce territory, and the timeline and cost both change.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California is &lt;/span&gt;&lt;a href="https://www.law.cornell.edu/wex/no-fault_divorce"&gt;&lt;u&gt;&lt;span&gt;a no-fault state&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, which means neither party must prove fault or show any&lt;/span&gt;&lt;span style="color: #333333; background-color: #ffffff;"&gt;&amp;nbsp;wrongdoing&lt;/span&gt;&lt;span&gt;. The divorce petition will normally cite "irreconcilable differences." The reason is that claims of cheating, lying, and general bad behavior during the marriage rarely impact the outcome. The purpose of the court is not meant to punish bad behavior or declare a winner but to divide property, resolve support, and, if you have kids, set a parenting plan. There are exceptions where bad behavior can impact the outcome, such as domestic violence, which does affect custody and support.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The Ground Rules&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Three very important rules impact EVERY divorce file in Los Angeles County Courts.&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Residency &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;- Under &lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=FAM&amp;amp;sectionNum=2320."&gt;&lt;u&gt;&lt;span&gt;Family Code section 2320&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, at least one spouse must have &lt;/span&gt;&lt;u&gt;&lt;span&gt;lived in California for six months and in the county where you file for three months before filing&lt;/span&gt;&lt;/u&gt;&lt;span&gt;. If you just moved to LA, you may need to wait, though you can &lt;/span&gt;&lt;a href="https://selfhelp.courts.ca.gov/divorce-california/legal-separation"&gt;&lt;u&gt;&lt;span&gt;file for legal separation first and amend to divorce once you qualify&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Waiting Period&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; - &lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=FAM&amp;amp;sectionNum=2339."&gt;&lt;u&gt;&lt;span&gt;Family Code section 2339&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;u&gt;&lt;span&gt;requires a minimum of six months between the date your spouse is served (or first appears in the case) and the date your marriage can legally end.&lt;/span&gt;&lt;/u&gt;&lt;span&gt; No judge can shorten this window, no matter how eager both sides are to be done. In a contested case, this rarely matters in practice, because contested cases almost always take longer than six months anyway.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Geography - Los Angeles County is enormous, and family law cases are heard at multiple courthouses, including &lt;/span&gt;&lt;a href="https://www.lacourt.ca.gov/apps/courthouse?ct=fl"&gt;&lt;u&gt;&lt;span&gt;Stanley Mosk in downtown LA, Pomona, Long Beach, Pasadena, Van Nuys, Torrance, and Santa Monica.&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; Your case gets assigned based on where you live which is fortunate because you will spend a lot of time going to and from the courthouse.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Step One: The Petition and the Summons and the Automatic Temporary Restraining Order and Response&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.5;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;The Petition for Divorce&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Every divorce starts the same way, even contested divorces.&amp;nbsp;&lt;/span&gt;&lt;span style="margin: 0px; padding: 0px;"&gt;One spouse,&amp;nbsp;&lt;span style="margin: 0px; padding: 0px;"&gt;known as the Petitioner, files a Petition for&amp;nbsp;&lt;strong&gt;Dissolution of Marriage along with a Summons&lt;/strong&gt; and pays the first-appearance&lt;/span&gt;&amp;nbsp;filing fee, which is&amp;nbsp;&lt;a href="https://courts.ca.gov/system/files/file/statewide-civil-fee-schedule-eff-01012026.pdf"&gt;&lt;u&gt;$435 to $450 under the statewide fee schedule&lt;/u&gt;&lt;/a&gt;.&lt;/span&gt;&lt;span&gt;&amp;nbsp;If that fee is a hardship, you can &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fw001.pdf"&gt;&lt;u&gt;&lt;span&gt;file Form FW-001 to ask the court to waive it&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; based on your income and expenses.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.5;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;The Summons&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The Summons must be personally served on your spouse, &lt;/span&gt;&lt;strong&gt;&lt;span&gt;but you can't do it yourself&lt;/span&gt;&lt;/strong&gt;&lt;span&gt;. Another person over 18, a professional process server, or the sheriff can serve the summons. &lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.5;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;The Automatic Temporary Restraining Order&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Printed on the back of that &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl110.pdf"&gt;&lt;u&gt;&lt;span&gt;Summons (Form FL-110) are automatic temporary restraining orders,&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; known as ATROs. The moment the case is filed and served, both spouses are barred from:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;span&gt;Removing minor children from the State or applying for a new or replacement passport.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Cashing in, borrowing against, or changing running. You have &lt;/span&gt;&lt;a href="https://www.gavel.io/court-forms/ca-fl-110-summons"&gt;&lt;u&gt;&lt;span&gt;30 days to file a Response (Form FL-120)&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, and filing it costs the same &lt;/span&gt;&lt;a href="https://courts.ca.gov/system/files/file/statewide-civil-fee-schedule-eff-01012026.pdf"&gt;&lt;u&gt;&lt;span&gt;first-appearance fee, around $435&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Ignoring the paperwork doesn't make the case go away. It makes it worse. If you don't respond, your spouse can seek a default judgment, and the court can grant much of what the petition asked for without hearing your side.  &lt;li&gt;Beneficiaries of any insurance or other coverage, including life, health, automobile, and disability, that is for the benefit of the parties and their minor children.&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Transferring, encumbering, concealing or in any way disposing of ANY property real or personal whether community, quasi-community, or separate without the written consent of the other party or an order of the court&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Creating or modifying a nonprobate transfer in a manner that affects the disposition of the property without the written consent of the other party or an order of the court&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;The Parties must notify each other of any extraordinary expenditures at least five business days before they are made and then provide an accounting to the court.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The Automatic Temporary Restraining Orders are binding on both Parties until the divorce petition is dismissed, a judgment is entered, or the court makes an order impacting them.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.2;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The Response&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;If you're the one who got served, the clock is running. &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl110.pdf"&gt;&lt;u&gt;&lt;span&gt;You have 30 days from the time you are served the Petition and Summons to file a response.&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; You must file that response with the Court using Form&amp;nbsp;&lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl120.pdf"&gt;&lt;u&gt;&lt;span&gt;FL-120&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. When you file with the court,&amp;nbsp; you must also pay a &lt;/span&gt;&lt;a href="https://courts.ca.gov/system/files/file/statewide-civil-fee-schedule-eff-01012026.pdf"&gt;&lt;u&gt;&lt;span&gt;first-appearance fee of $435&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. You must also serve the same form on the Petitioner (spouse).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Ignoring the paperwork does not make the case go away. It is vitally important that your response fulfills these requirements. A letter, phone call, or even a court appearance will not protect you. Failing to make the appropriate timely response can adversely impact your marriage, property, finances, and custody of your children.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The End of the Beginning&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A contested divorce in Los Angeles County is a long process with many procedures. We just introduced you to the first phase of the process and what you can expect. &lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;The Expectation - the Agreement Holds&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Two paths may occur when a prenuptial agreement is involved in a divorce proceeding. If the prenuptial is deemed invalid, the matters otherwise covered by the agreement become part of what can become a long and expensive litigation where one party may have a lot to lose.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California community property laws then dictate that what the couple owns or owes together during marriage is divided equally. While each spouse keeps their separate property, which is what each owned or owed before marriage, if during the marriage money went to improve or pay a mortgage, that difference can also be considered community property. Each party keeps assets acquired after the date of separation, plus gifts and inheritances received at any time. Anything acquired while living outside California is quasi-community property and gets treated like community property. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The valuation of assets or when the parties actually separated can become highly litigated issues.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A valid prenup replaces all of that with whatever the parties agreed to when they had better intentions with each other. In practice, it eliminates characterization arguments, tracing exercises, and most of the expert work. A case that would have needed a forensic accountant to untangle commingled accounts becomes a drafting exercise.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;What it doesn't eliminate is worth listing, because clients consistently expect otherwise.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Financial disclosure still happens. Sharing financial information is a required step in every divorce or legal separation. The petitioner's preliminary disclosure is due within 60 days of filing the Petition and the respondent's within 60 days of filing the Response. The disclosure waiver in section 1615 is premarital, and it does nothing for the dissolution-stage obligation. Hide assets at this stage, and the judge can award property to your spouse or order you to pay their attorney's fees.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The six months still runs. The earliest a divorce can be final is six months from the day the other spouse was served or responded, whichever comes first. Orange County states the rule the same way and adds that no divorce is final until a Judgment of Dissolution is signed by a judge, which one of the parties has to prepare and submit. A prenup that resolves every financial issue on day one buys you nothing on the calendar.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;The mechanics diverge sharply between the two counties&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Los Angeles is geographic. The Superior Court operates 36 courthouses across twelve districts, and your case belongs in the district courthouse rather than the one closest to you. [13] Orange County is the opposite: all family law documents relating to dissolution, legal separation, and nullity must be filed at the Lamoreaux Justice Center only, at 341 The City Drive South in Orange. [17] One county, one family law filing counter.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Orange County also has residency and paperwork wrinkles worth knowing. A party must have lived in California for six months and in Orange County for the three months immediately preceding the filing of the Petition. [17] The initial packet includes a local form, the Family Law Declaration Regarding Related Cases (L1120), alongside the FL-100 and FL-110. [17] And attorneys don't have a choice about filing method: under Code of Civil Procedure section 1010.6, California Rule of Court 2.253(b)(2) and Orange County Local Rule 700.7, documents filed by attorneys in family law cases must be filed electronically unless the court excuses them, with self-represented parties exempt but encouraged to participate. That mandate was expanded to cover ex parte filings effective January 2, 2024. [18]&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;For couples whose prenup resolves everything, Orange County offers two shortened tracks. Summary dissolution is available to couples married less than five years with no children, little property and little debt. [17] Couples who don't qualify can file a Joint Petition and Joint&lt;/span&gt;&lt;span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;How a Disputed Prenuptial Agreement Is Handled in Los Angeles and Orange County&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A challenged prenup doesn't get resolved alongside everything else. It gets tried and usually tried first. The reason the validity of the prenup is tried and determined first is that if the agreement stands, everything downstream collapses into a drafting exercise. If it falls, you're doing a full community property trial with tracing, valuation dates, and experts. Nobody wants to prepare both cases at once, so the validity question goes first.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;When a spouse disputes a prenuptial agreement during divorce,&lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-1615/"&gt;&lt;u&gt;&lt;span&gt; California Family Code § 1615&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; governs the challenge in both counties — the substantive law is identical statewide. What differs is the procedural pathway, court structure, and local case management practices that shape how the dispute moves through the system&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;One major difference is a geographic one. In Los Angeles County, there are twelve courts that handle family law cases. The determination of which courthouse will handle your case is based on both the city/zip code of the petitioner and the court docket. So the fact that your address falls within a particular district’s geographic boundaries does not necessarily mean your case will be assigned to that district. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;In Orange County, all divorces are handled at the Lamoreaux Justice Center.&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;To properly file this, you need to:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span&gt;To properly complete this request in California, you must bundle the following documents together:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;a href="https://courts.ca.gov/system/files?file=2025-07/fl300.pdf"&gt;&lt;strong&gt;&lt;u&gt;&lt;span&gt;Form FL-300 (Request for Order&lt;/span&gt;&lt;/u&gt;&lt;/strong&gt;&lt;/a&gt;&lt;strong&gt;&lt;span&gt;):&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; This is the master motion form.  &lt;li&gt;&lt;strong&gt;&lt;span&gt;Supporting Declaration:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Under Item 10 of Form FL-300 (or on a separate &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/mc030.pdf"&gt;&lt;u&gt;&lt;span&gt;Form MC-030 Declaration)&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, you must write a factual statement explaining &lt;/span&gt;&lt;em&gt;&lt;span&gt;why&lt;/span&gt;&lt;/em&gt;&lt;span&gt; a separate trial is necessary and how deciding the prenup's validity early will save the court time or simplify asset division. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Preliminary Financial Disclosures:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Under California family law, you generally &lt;/span&gt;&lt;strong&gt;&lt;span&gt;must complete and serve your Preliminary Declaration of Disclosure&lt;/span&gt;&lt;/strong&gt;&lt;span style="white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl140.pdf"&gt;&lt;u&gt;&lt;span&gt;(Form FL-140&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;), along with your schedule of assets/debts and income declarations (&lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl150.pdf"&gt;&lt;u&gt;&lt;span&gt;Form FL-150)&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; before or alongside your request for a separate trial. &lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Criteria for Validity and Fairness of Prenuptial Agreements in California&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;That trial is about more than the contract language. It's also about the transaction, and the transaction may have happened twenty years ago&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California courts apply a two-part test under &lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-1615/"&gt;&lt;u&gt;&lt;span&gt;Family Code § 1615&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; to determine whether a prenuptial agreement is enforceable: &lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;span&gt;whether it was executed voluntarily, and&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;whether it was unconscionable when executed. &lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The party seeking to enforce the prenup bears the burden of proving voluntariness by clear and convincing evidence, while the party challenging it must prove unconscionability.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The Voluntariness Test: Five Mandatory Findings&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Under &lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-1615/"&gt;&lt;u&gt;&lt;span&gt;Family Code § 1615(c),&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; a prenup is presumed unenforceable unless the court makes written or on-the-record findings on all five of the following elements:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Independent legal counsel or written waiver&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; — The party against whom enforcement is sought was represented by independent counsel at signing, or was advised to seek counsel and expressly waived that right in a separate written instrument.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Seven-day waiting period&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; — At least seven calendar days elapsed between the time the party was first presented with the final agreement and advised to seek counsel, and the time the agreement was signed. For agreements executed on or after January 1, 2020, this seven-day rule applies uniformly.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Full informed understanding (if unrepresented)&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; — If the party was not represented by counsel, they were fully informed of the terms and basic effect of the agreement, the rights and obligations they were giving up, and were proficient in the language in which the explanation was conducted and in which the agreement was written.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;No duress, fraud, or undue influence&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; — The agreement and related waiver writings were not executed under duress, fraud, or undue influence, and the parties had legal capacity to enter the agreement.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Catch-all provision&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; — Any other factors the court deems relevant.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;The Unconscionability Test: Two-Prong Analysis&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A prenup can also be invalidated if the challenging party proves it was unconscionable when executed and all three of the following disclosure failures occurred:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;span&gt;The challenging party was not provided a fair, reasonable, and full disclosure of the other party’s property or financial obligations.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;The challenging party did not voluntarily and expressly waive, in writing, the right to disclosure beyond what was provided.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;The challenging party did not have, or reasonably could not have had, adequate knowledge of the other party’s property or financial obligations.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California courts evaluate unconscionability using two distinct dimensions:&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="list-style-type: lower-alpha;"&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Procedural unconscionability&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; - Whether the process was fair — oppression from unequal bargaining power, surprise from hidden or unexpected provisions, timing pressure&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Substantive unconscionability&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; - Whether the terms are one-sided and unreasonable, lacking justification — assessed at the time of signing, not enforcement&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;It is important to note that spousal support waivers are afforded scrutiny than property division terms. Under &lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-1612/"&gt;&lt;u&gt;&lt;span&gt;Family Code § 1612(c),&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; a spousal support waiver or limitation is enforceable only if:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;span&gt;Both parties were represented by independent counsel at the time of execution — this is mandatory, not waivable.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;The waiver is not unconscionable at the time of enforcement — this is a separate, forward-looking test distinct from the at-execution standard.&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;For the enforcement-time unconscionability analysis of spousal support waivers, the court considers:&lt;/span&gt;&lt;/p&gt; 
&lt;ol&gt; 
 &lt;li&gt;&lt;span&gt;Whether more than ten years have passed since execution&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Whether a child was born or adopted by the parties&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Whether there has been a material change in circumstances affecting the supported party’s ability to support themselves&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;The outcome if the waiver is enforced versus the outcome without it&lt;/span&gt;&lt;/li&gt; 
&lt;/ol&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;If the waiver falls, the judge doesn't invent a number. The court applies the &lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-4320/"&gt;&lt;u&gt;&lt;span&gt;Family Code section 4320&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="margin: 0px; padding: 0px;"&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-4320/"&gt;&lt;u&gt;,&lt;/u&gt;&lt;/a&gt;&amp;nbsp;&lt;/span&gt;&lt;span&gt;where the court shall consider all the following factors:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(a) The extent to which the earning capacity of each party is sufficient to maintain the standard of living established during the marriage, taking into account all of the following:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(1) The marketable skills of the supported party; the job market for those skills; the time and expenses required for the supported party to acquire the appropriate education or training to develop those skills; and the possible need for retraining or education to acquire other, more marketable skills or employment.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(2) The extent to which the supported party's present or future earning capacity is impaired by periods of unemployment that were incurred during the marriage to permit the supported party to devote time to domestic duties.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(b) The extent to which the supported party contributed to the attainment of an education, training, a career position, or a license by the supporting party.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(c) The ability of the supporting party to pay spousal support, taking into account the supporting party's earning capacity, earned and unearned income, assets, and standard of living.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(d) The needs of each party based on the standard of living established during the marriage.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(e) The obligations and assets, including the separate property, of each party.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(f) The duration of the marriage.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(g) The ability of the supported party to engage in gainful employment without unduly interfering with the interests of dependent children in the custody of the party.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(h) The age and health of the parties.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Custody stays outside the agreement in both counties&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;No matter what the prenup says, custody and child support run on their own track. Child &lt;/span&gt;&lt;span&gt;support cannot be adversely affected by a premarital agreement. Custody disputes go through mediation before a judge hears them. Mediation covers legal custody, physical custody, and visitation only. Child support, spousal support, and evidence against the other parent are excluded and go to the judge. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;This process will be discussed in a separate blog article.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span style="color: #101012;"&gt;Summary:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span&gt;It is now deemed more acceptable for a couple to have a prenuptial agreement. A prenuptial agreement is no longer viewed as a sign that one party expects a divorce. It’s now more often seen as a prudent step couples take to protect against the unexpected, should a divorce happen.&lt;/span&gt;&lt;/li&gt;

&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In reality, a prenuptial agreement either makes the divorce immensely simpler because some of the points that are often the most litigated have already been ironed out before the marriage, or it becomes the main element of dispute. If there are questions about validity or whether the prenup was properly reviewed and considered, the agreement itself becomes the fight. All of this turns on events that occurred years before the divorce itself.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;What is the Prenuptial Agreement Allowed to Decide? &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The answer to this question can be found in the &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-4/part-5/chapter-2/article-2/section-1612/"&gt;&lt;u&gt;&lt;span&gt;Family Code section 1612&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;,&lt;span&gt; which sets the scope and limits of what may be included in a prenuptial agreement:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;Parties to a premarital agreement may contract with respect to all the following:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(1) The rights and obligations of each of the parties of any property owned by either or both of them.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(2) The right to buy, sell, encumber and otherwise control property; the disposition of property on separation,&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(3) The disposition of property upon separation, marital dissolution, or death. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(4) The making of a will, trust, or other arrangement to carry out the provisions of the agreement.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(5) Ownership of a life insurance death benefit policy.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(6) The choice of law governing the construction of the agreement.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;(7) Any other matter not in violation of public policy or a statute imposing a criminal penalty.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;What Cannot Be Included in a California Prenuptial Agreement?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California sets forth specific items that are forbidden to be included in ANY prenuptial agreement even if both parties wish for them to be included. The forbidden areas are:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Child Custody and Visitation:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Courts decide custody based on the best interests of the child at the time of a separation, so future arrangements cannot be predetermined. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Child Support:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Parents cannot contract away or limit a child's right to adequate financial support under California Family Code Section 1612(c).&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Non-Financial Personal Demands:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Lifestyle rules, household chores, weight requirements, or decisions about who to spend holidays with are not enforceable. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Illegal Acts:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Any requirement or incentive to break the law or violate public policy is completely void. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Provisions Encouraging Divorce:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Clauses that act as a financial incentive or reward to trigger a divorce will not be upheld. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Unconscionable Spousal Support Waivers:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; While alimony can be addressed, a waiver of spousal support may be thrown out if it is unconscionable or if the receiving party did not have independent legal representation. The issue of unconscionability means that the deal was so one-sided or heavy-handed that it is not enforceable. The test for being unconscionable is looked at both at the time of signing and at the time of the divorce.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;What are the Requirements for Creating a Valid Prenuptial?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Like any valid contract, in California there must be an offer and acceptance of the terms and a meeting of the minds. This latter requirement is often the matter in dispute. In essence, it means that there is a mutual understanding, agreement, or shared opinion between both individuals. That they are "on the same page" and have the same expectations and belief in what they are agreeing to in their prenup. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;The rules setting forth what is required for a valid prenup are designed to ensure that the soon-to-be wed parties have the same understanding and belief regarding the terms and the ultimate outcome.&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span style="margin: 0px; padding: 0px;"&gt;The provisions that California law sets forth should be viewed as the bar minimum, and to ensure enforceability, the parties often exceed these requirements because California law&amp;nbsp;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displayText.xhtml?lawCode=FAM&amp;amp;division=4.&amp;amp;title&amp;amp;part=5.&amp;amp;chapter=2.&amp;amp;article=2."&gt;&lt;u&gt;allows the court to consider any factors the court deems relevant when considering the validity of any prenuptial agreement.&lt;/u&gt;&lt;/a&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The core legal requirements are:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Written Document:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Oral prenuptial agreements are not legally binding; the entire contract must be documented in writing. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Voluntary Signatures:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Both individuals must sign the agreement willingly, free from coercion, fraud, or duress&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Full Financial Disclosure:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Each partner must provide a complete, honest accounting of all assets, property, income, and debts. Hiding assets can invalidate the agreement. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Independent Legal Counsel:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Both parties generally need separate, independent attorneys to represent their individual interests— However, If one party does not wish to engage separate counsel, it is incumbent that you can demonstrate: that the non-represented party &lt;/span&gt;&lt;/li&gt; 
 &lt;ul&gt; 
  &lt;li&gt;&lt;span style="color: #333333; background-color: #ffffff;"&gt;was fully informed of the terms and basic effect of the agreement &lt;/span&gt;&lt;/li&gt; 
  &lt;li&gt;&lt;span style="color: #333333; background-color: #ffffff;"&gt;was fully informed as to the rights and obligations the party was giving up by signing the agreement&lt;/span&gt;&lt;/li&gt; 
  &lt;li&gt;&lt;span style="color: #333333; background-color: #ffffff;"&gt;They were proficient in the language in which the explanation of the party’s rights was conducted and in which the agreement was written. &lt;/span&gt;&lt;/li&gt; 
  &lt;li&gt;&lt;span style="color: #333333; background-color: #ffffff;"&gt;The explanation of the rights and obligations relinquished shall be memorialized in writing and delivered to the party prior to signing the agreement. This must be a separate agreement and not bound in the prenuptial agreement.&lt;/span&gt;&lt;/li&gt; 
 &lt;/ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;The 7-Day Rule - &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;The receiving spouse must have at least seven days to review the final agreement before signing it. &lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The enforceability gauntlet&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;If you find yourself a party to a divorce which involves a prenuptial agreement and that agreement is in dispute, the Court will look to &lt;/span&gt;&lt;a href="https://leginfo.legislature.ca.gov/faces/codes_displayText.xhtml?lawCode=FAM&amp;amp;division=4.&amp;amp;title&amp;amp;part=5.&amp;amp;chapter=2.&amp;amp;article=2."&gt;&lt;u&gt;&lt;span&gt;Section 1615&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; to determine if the agreement is unenforceable. This includes all the elements we just discussed.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;While some of these provisions seem pretty straightforward (e.g., written document, voluntarily signed by both parties). Other items can be more problematic (e.g., full disclosure, conscionability of the terms).&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A well-documented agreement should be able to demonstrate that full disclosure was made by the listing of the documents. However, unconscionability is a more ambiguous criterion. Unconscionability is decided by the judge as a matter of law. This means that the judge, after reviewing all the facts in the case, makes the final determination of whether the agreement that was generated years prior is enforceable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;This makes it imperative that when drafting the prenuptial agreement you view it through the lens of a judge who will consider:&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span&gt;the agreement was not signed under duress, fraud or undue influence, and neither party lacked capacity; &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;whether the terms were so one-sided it is fundamentally unfair.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;any other factors the court deems relevant.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span style="color: #101012;"&gt;Summary:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span style="color: #101012;"&gt;Prenuptial agreements&lt;/span&gt;&lt;span style="color: #111111; background-color: #ffffff;"&gt; can streamline and make a divorce a less contentious&amp;nbsp;&lt;/span&gt;&lt;span style="color: #101012;"&gt;&lt;span style="margin: 0px; padding: 0px;"&gt;&lt;span style="color: #111111;"&gt;experience&amp;nbsp;&lt;/span&gt;if&lt;/span&gt;&amp;nbsp;prepared properly and in accordance with the Family Law Code Sections &lt;/span&gt;&lt;span style="color: #111111; background-color: #ffffff;"&gt;1610 – 1617. &lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;In this blog, we explain why AI gets it wrong so often: even though each new iteration seems smarter and more reliable, the way it learns is inherently flawed and will always produce erroneous answers.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Why AI Gets the Law Wrong So Often&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In the first blog of this series, we shared that AI often produces fake case citations that appear for all intents and purposes to be actual cases. It helps to understand that the fake-case problem isn't a rare glitch. It's a built-in feature of how these systems work. A chatbot generates text that's statistically plausible; it has no internal concept of whether a case is real. When researchers at Stanford tested this rigorously, the results were sobering. General-purpose chatbots &lt;/span&gt;&lt;a href="https://www.lawnext.com/2024/06/in-redo-of-its-study-stanford-finds-westlaws-ai-hallucinates-at-double-the-rate-of-lexisnexis.html"&gt;&lt;u&gt;&lt;span&gt;hallucinated on legal questions between 58% and 80% of the time&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. Even the expensive professional tools built specifically for lawyers, with real legal databases behind them, produced false information at meaningful rates: &lt;/span&gt;&lt;a href="https://www.lawnext.com/2024/06/in-redo-of-its-study-stanford-finds-westlaws-ai-hallucinates-at-double-the-rate-of-lexisnexis.html"&gt;&lt;u&gt;&lt;span&gt;17% for LexisNexis's AI and more than 33% for Westlaw's&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. The free chatbot on your phone is worse than both, and the errors &lt;/span&gt;&lt;a href="https://www.lawnext.com/2024/06/in-redo-of-its-study-stanford-finds-westlaws-ai-hallucinates-at-double-the-rate-of-lexisnexis.html"&gt;&lt;u&gt;&lt;span&gt;aren't limited to invented cases; they include real cases described as saying things they don't say&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, which is harder to catch and just as damaging.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;There's a second, quieter problem: staleness. AI models learn from data with a cutoff date, and California family law doesn't hold still. Here's a concrete example that could cost a divorcing parent real money. California's child support formula got its &lt;/span&gt;&lt;a href="https://dcss.ca.gov/2024/09/03/supportcalculationchanges/"&gt;&lt;u&gt;&lt;span&gt;first major overhaul since 1992 when Senate Bill 343 took effect on September 1, 2024&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, changing what counts as income and how add-on expenses like childcare get divided between parents. A chatbot trained before that date, or one leaning on the thousands of older articles in its training data, will confidently explain the old rules. You'd have no way to know the answer was obsolete, because the answer doesn't come with a freshness date. Support gets calculated under &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-9/part-2/chapter-2/article-2/section-4055/"&gt;&lt;u&gt;&lt;span&gt;Family Code section 4055&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; using current law, whether your chatbot has heard of it.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Even if the AI tool you are using has been trained to scrape the internet for answers, it does not make it a trustworthy source. The internet is fraught with misinformation, and the AI model has no way of ascertaining if the information being shared with you is accurate and reliable. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Why would you trust ANY tool that has a track record of being wrong so often? Even if it sources the data, it can only be as accurate as when it was trained or uses everything and anything it may find on the internet?&lt;/span&gt;&lt;/p&gt;

You can’t imagine how you will be able to afford those costs and still live. Then you remember, you have the knowledge of all mankind sitting right on your laptop. ChatGPT is free, it's awake, and it answers every question in confident, polished paragraphs. So, you start typing. What could go wrong?&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Millions of people are faced with this exact scenario. The information being shared by ChatGPT or any of the many artificial intelligence platforms looks professional and sounds lawyerlike. However, the fallacy of that belief does not show up in the chat window. They show up months later, in a courtroom in Santa Ana or downtown Los Angeles, when a judge asks you about where a case citation came from, or when your spouse's attorney serves a subpoena for records you assumed were private, or when you discover the "settlement advice" you followed gave away a pension share worth six figures.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;This is a two-part blog series. In part one, we will lay out the risks in detail. In the second blog, we will discuss why AI gets it wrong so often and what the better alternative is if you want to DIY and save tens of thousands of dollars. We separated this blog into two parts because we really want you to focus on the ramifications that using AI can have and how it can destroy your credibility and case.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The uncomfortable part that should get your attention before anything else: it is not a question of being smart enough to figure out what you should or shouldn’t use. The people getting burned by AI in court aren't just anxious spouses typing questions at midnight. They include licensed attorneys at big firms, with decades of experience. If AI is tripping up the professionals, it's worth asking what it will do to someone facing the most consequential legal proceeding of their life without any legal training at all.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Start With the Lawyers Who Got Caught&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The first famous casualty was a New York personal injury lawyer named Steven Schwartz. In 2023, in a case called &lt;/span&gt;&lt;a href="https://en.wikipedia.org/wiki/Mata_v._Avianca,_Inc."&gt;&lt;u&gt;&lt;span&gt;Mata v. Avianca&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, Schwartz used ChatGPT to research a brief and filed it with six case citations supporting his argument. None of the six cases existed. ChatGPT had invented them, complete with realistic-sounding names, docket numbers, and quotes. When opposing counsel and the judge couldn't find the cases, Schwartz went back to ChatGPT and asked if the cases were real. It assured him they were. The court &lt;/span&gt;&lt;a href="https://legalclarity.org/what-happened-in-the-mata-v-avianca-case/"&gt;&lt;u&gt;&lt;span&gt;fined Schwartz, his co-counsel, and their firm $5,000 and ordered them to send letters to every real judge falsely named as an author of the fake opinions&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. The story ran in national newspapers with his name attached, which is a penalty no fine can match.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;You might expect the profession to have learned its lesson. It didn't, and California produced two of the most instructive follow-ups.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In September 2025, a California Court of Appeal issued the state's first published opinion on AI-fabricated citations, &lt;/span&gt;&lt;a href="https://caselaw.findlaw.com/court/crt-app-sec-dis-cal-div-thr/117694279.html"&gt;&lt;u&gt;&lt;span&gt;Noland v. Land of the Free, L.P&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="margin: 0px; padding: 0px;"&gt;&lt;a href="https://caselaw.findlaw.com/court/crt-app-sec-dis-cal-div-thr/117694279.html"&gt;&lt;u&gt;.&lt;/u&gt;&lt;/a&gt;&lt;/span&gt;&lt;span&gt;&amp;nbsp;The plaintiff's attorney had used generative AI to draft his appellate briefs without verifying what it produced. Of the &lt;/span&gt;&lt;a href="https://www.mcguirewoods.com/client-resources/alerts/2025/9/california-appellate-court-issues-10k-sanctions-in-states-first-published-opinion-on-ai-hallucinated-case-citations/"&gt;&lt;u&gt;&lt;span&gt;23 case quotations in his opening brief, 21 were fabricated&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. Entire passages were attributed to published opinions that said no such thing; some of the cited cases didn't exist at all. The court &lt;/span&gt;&lt;a href="https://www.mcguirewoods.com/client-resources/alerts/2025/9/california-appellate-court-issues-10k-sanctions-in-states-first-published-opinion-on-ai-hallucinated-case-citations/"&gt;&lt;u&gt;&lt;span&gt;sanctioned the attorney $10,000, ordered him to send the opinion to his own client, and referred him to the State Bar of California&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; for possible discipline.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A few months earlier and a few miles away, in federal court in Los Angeles, two large law firms learned the same lesson at triple the price. In &lt;/span&gt;&lt;a href="https://abovethelaw.com/2025/05/law-firms-use-artificial-intelligence-to-earn-very-real-31k-sanction/"&gt;&lt;u&gt;&lt;span&gt;Lacey v. State Farm&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, a judge in the Central District of California sanctioned the firms &lt;/span&gt;&lt;a href="https://incidentdatabase.ai/cite/1073/"&gt;&lt;u&gt;&lt;span&gt;$31,000 after they filed a brief with AI-generated citation errors, failed to disclose the AI use, and then refiled a "corrected" version that contained new inaccuracies&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. The judge called the conduct reckless and the filings misleading.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;These aren't isolated embarrassments. A researcher named Damien Charlotin maintains a &lt;/span&gt;&lt;a href="https://www.damiencharlotin.com/hallucinations/"&gt;&lt;u&gt;&lt;span&gt;public database of court decisions involving AI-hallucinated citations&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, and by mid-2026 it had &lt;/span&gt;&lt;a href="https://www.haqq.ai/blog/ai-legal-hallucination-audit"&gt;&lt;u&gt;&lt;span&gt;documented well over a thousand cases worldwide, with more than a thousand in the United States alone&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. The tracker grew so fast that &lt;/span&gt;&lt;a href="https://www.forbes.com/sites/larsdaniel/2025/07/18/attorneys-track-ai-hallucination-case-citations-with-this-new-tool/"&gt;&lt;u&gt;&lt;span&gt;Forbes covered it as an essential tool for attorneys&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span style="background-color: transparent;"&gt;If trained lawyers, who know how to research cases and who have access to such real legal databases as&amp;nbsp;&lt;/span&gt;&lt;a href="https://legal.thomsonreuters.com/en/westlaw" style="background-color: transparent;"&gt;&lt;u&gt;Westlaw&lt;/u&gt;&lt;/a&gt;&lt;span style="background-color: transparent;"&gt;&amp;nbsp;and&amp;nbsp;&lt;/span&gt;&lt;a href="http://lexisnexis.com/" style="background-color: transparent;"&gt;&lt;u&gt;LexisNexis,&lt;/u&gt;&lt;/a&gt;&lt;span style="background-color: transparent;"&gt;&amp;nbsp;have failed so miserably using AI, what chance do you have to get it right?&lt;/span&gt;&lt;span&gt;&amp;nbsp;Are you willing to risk your financial future or custody of your children on a hope that you will not be misled? &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;The Courts Will Not Save You&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;span style="color: #1a1a1a;"&gt;California family law courts are considered courts of equity, which have flexibility to fashion appropriate equitable remedies to achieve fairness. However, this does not mean that the Court will provide you slack if you use fantasy citations or fail to file on time due to bad AI advice. The Court is also not allowed to tell you what you should be doing. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span style="color: #15232b;"&gt;Pro se litigants (individuals representing themselves) typically commit more fundamental mistakes, such as citing completely fabricated cases, copying and pasting legal arguments without verification, or misunderstanding basic procedural requirements because they trusted AI suggestions. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span style="color: #15232b;"&gt;These errors often appear across multiple rounds of amendments and rarely self-correct before court intervention. &lt;/span&gt;&lt;span style="color: #101012; background-color: #ffffff;"&gt;In 2025, pro se litigants (those representing themselves) &lt;/span&gt;&lt;a href="https://csdisco.com/blog/ai-hallucinations-legal-decisions-trends?utm_source=you.com#:~:text=A%20newly%20expanded%20database,face%20very%20real%20risks."&gt;&lt;u&gt;&lt;span style="background-color: #ffffff;"&gt;accounted for 39% more hallucination-related incidents than attorneys&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span style="color: #101012; background-color: #ffffff;"&gt;, highlighting the heightened risk for self-represented parties&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Family law judges in Los Angeles and Orange County see thousands of self-represented parties, and most judges are patient with honest confusion about procedure. What they are not patient with is a brief or declaration quoting cases that don't exist, because at that point you haven't made a mistake; you've put false information in front of a court, signed under penalty of perjury. Judges have responded with &lt;/span&gt;&lt;a href="https://hsjchronicle.com/self-represented-litigants-turn-to-ai-as-legal-shortcut-with-mixed-results/"&gt;&lt;u&gt;&lt;span&gt;fines, community service, and dismissed filings&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. And in a divorce, there's a subtler penalty that never appears in a sanctions order: the judge who caught you filing fiction now doubts everything else you say, including your testimony about income, assets, and parenting. Credibility is the currency of family court, and it doesn't come back once it's spent.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span style="color: #1a1a1a;"&gt;Your Chats Are Not Private, and Your Spouse's Lawyer Knows It&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

In litigation, it's better understood as &lt;/span&gt;&lt;a href="https://futurism.com/chatgpt-legal-questions-court"&gt;&lt;u&gt;&lt;span&gt;a diary that can be subpoenaed&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;. &lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Contested custody in Los Angeles County requires Family Court Services mediation before the hearing. Parents must also complete PACT, the Parents and Children Together orientation, through the court's online program or in person at the Stanley Mosk site, 111 North Hill Street, Room 222. Mediation is provided at no cost and typically runs 90 minutes to two hours. If the parents reach agreement, the judge signs it, and it becomes an enforceable order. &lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In recommending counties, the child custody recommending counselor submits a written recommendation to the judge, and that recommendation frequently determines the outcome. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Both Los Angeles and Orange County run confidential mediation instead. Orange County states the rule plainly: what parents discuss with the Court Mediator is not shared with anyone, including the court, except in suspected child abuse cases. The practical consequence is that a failed mediation in either county leaves the judge hearing the custody evidence fresh, with no counselor's report on the file.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Do we still have to exchange financial disclosures if we agree on everything?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Yes, and this is where uncontested judgment packets most often get rejected in both counties. Family Code sections &lt;/span&gt;&lt;a href="https://codes.findlaw.com/ca/family-code/fam-sect-2104/"&gt;&lt;u&gt;&lt;span&gt;2104&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; and &lt;/span&gt;&lt;a href="https://california.public.law/codes/family_code_section_2105"&gt;&lt;u&gt;&lt;span&gt;2105&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; require preliminary and final Declarations of Disclosure. &lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The restraining order request runs on its own track with its own hearing, and it is contested the moment the responding party opposes it. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The criteria the courts use for determining child custody are the best interests of a child. &lt;/span&gt;&lt;span style="background-color: #ffffff;"&gt;If a party seeking custody has perpetrated domestic violence within the previous five years against the other party seeking custody of the child, or against the child or the child's siblings, or &lt;/span&gt;&lt;span&gt;a cohabitant, or someone with whom the person has or had a dating or engagement relationship, &lt;/span&gt;&lt;span style="background-color: #ffffff;"&gt;there is a rebuttable presumption that an award of sole or joint physical or legal custody of a child to a person who has perpetrated domestic violence is detrimental to the best interest of the child&lt;/span&gt;&lt;/p&gt;

Other frequent triggers include discovery of an account or income stream that was not disclosed, disagreement over the date of separation, a business or professional practice that requires valuation, unvested stock or deferred compensation, one spouse refusing to sign a settlement agreement after negotiating its terms, and a request for a domestic violence restraining order.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Can a contested case become uncontested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Yes, and the large majority do. California dissolutions overwhelmingly settle rather than reach trial. &lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In court fees, very little. California's statewide first-paper fee is $435 for the petition and another $435 if a Response is filed, so a contested case starts around $870 in court costs against $435 for an uncontested one, or a single fee for a joint petition. A Request for Order adds roughly $60. Fee waivers are available for households at or below 125 percent of federal poverty guidelines and for recipients of Medi-Cal, CalWORKs, and similar benefits. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The real cost difference is attorney time. Discovery, depositions, forensic accountants, custody evaluators, and trial preparation are what separate a four-figure uncontested divorce from a six-figure contested one.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Do I need a lawyer to finish an uncontested divorce?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;No. The limitation is more of a practical one. Do you feel capable and knowledgeable to proceed on your own? Both counties operate self-help centers and family law facilitators at no cost. In reality, most spouses do uncontested divorces without an attorney. &lt;/span&gt;&lt;/p&gt;

 &lt;li&gt;&lt;span&gt;An uncontested divorce is when both parties can agree on all the issues (e.g., division of assets, support, custody) of the divorce. That is why most uncontested dissolutions in Los Angeles and Orange County never involve a courtroom appearance.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;A contested divorce requires a judicial ruling because the parties can not agree on at least one or more of the issues involved in the case.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Do Los Angeles or Orange County courts formally label a case contested or uncontested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;No. There is no checkbox for it. The Petition (Form FL-100) is identical either way, and the case number issued at the courthouse carries no classification. The status emerges from what happens after filing. Every California dissolution starts on the same procedural track and diverges based on the parties' conduct and ability to agree on the outcome.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What are the three ways a case can be finished without a trial?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Uncontested with a Response on file&lt;/span&gt;&lt;/strong&gt;&lt;span&gt;. The respondent filed Form FL-120, then the parties reached a complete written agreement.&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;All three end with a judge signing Form FL-180 without hearing testimony. The court mails Form FL-190, the Notice of Entry of Judgment, when the case is complete.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;My spouse filed a Response. Is my divorce now contested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Not necessarily, and this is a common misunderstanding. When a party files Form FL-120, it simply preserves the right to be heard and prevents a default judgment. It is a defensive move, not a declaration of war. Form FL-120 (Response—Marriage/Domestic Partnership) is the official California court document used by a respondent to reply to a divorce, legal separation, or annulment petition.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The case becomes contested when the parties can’t agree on the terms of a divorce settlement and someone asks the judge to decide something. This is often initiated by a Request for Order (Form FL-300), which is the standard legal procedure in California family law to ask a judge for new orders or to change existing ones.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What issues must be agreed on for a case to count as uncontested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;span&gt;The law defines date of separation as the day there was a &lt;/span&gt;&lt;strong&gt;&lt;span&gt;complete and final break &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;in your marriage. This can be ascertained by&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Expressed intent&lt;/span&gt;&lt;/strong&gt;&lt;span&gt;: One spouse must clearly state to the other that they want to end the marriage.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Consistent conduct&lt;/span&gt;&lt;/strong&gt;&lt;span&gt;: The actions of that spouse must match their stated intent to split.&lt;/span&gt;&lt;/li&gt;

&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Does one of the spouses need to have moved out for there to be an official date of separation?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

What uncontested status eliminates is everything after: no discovery, no motion practice, no hearing dates competing for calendar space in a crowded Los Angeles department, no trial. An uncontested case in either county typically finishes shortly after the six-month mark. A contested case in Los Angeles County commonly runs 12 to 24 months, and longer if a custody evaluation or business valuation is involved.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Where do I file in Los Angeles County, and does the courthouse matter?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Los Angeles County Superior Court assigns family law cases by district, based on the residence ZIP code, across a multi-site system. Family law filings are handled at the Stanley Mosk Courthouse (111 North Hill Street, Central District), Van Nuys Courthouse East, the Torrance Courthouse (Southwest District), Pomona Courthouse South, and the Governor George Deukmejian Courthouse in Long Beach, among others. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Parties represented by counsel must file electronically under the court's mandatory e-filing order for family law; self-represented litigants may e-file but are not required to. The courthouse does not change the legal test, but it changes how long you wait for a hearing date, which is often what decides whether a marginal dispute is worth litigating.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Where do I file in Orange County?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Orange County consolidates family law at the Lamoreaux Justice Center, 341 The City Drive, Orange, California 92868. This single-site structure is a significant procedural difference from Los Angeles County. One clerk's office handles all family law filings, and Family Court Services sits in the same building on the fifth floor, Room 507. Documents may be submitted electronically under Orange County Local Rule 700.7, by mail, or in person.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Does the Los Angeles or Orange County filing change whether my case is contested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The legal standard is statewide and identical in both counties. What differs is friction. Los Angeles County's volume and multi-district structure mean longer waits for hearing dates and judgment packet review, which raises the practical cost of staying contested. Orange County's single family law site tends to move judgment packets through faster. Neither county uses a different definition of contested, but local calendar realities influence how many cases settle rather than litigate.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What happens when custody is contested in Los Angeles County?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Contested custody in Los Angeles County requires Family Court Services mediation before the hearing. Parents are also required to complete PACT, the Parents and Children Together orientation, which can be done through the court's online program or in person at the Stanley Mosk site, 111 North Hill Street, Room 222. Mediation is provided at no cost and typically runs 90 minutes to two hours. If the parents reach agreement, the judge signs it, and it becomes an enforceable order. If not, the issue is litigated.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What happens when custody is contested in Orange County?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Orange County requires the same mediation under Family Code section 3170, administered by Family Court Services at Lamoreaux. Before the appointment, parties must submit an intake form and watch the Orientation to Mediation video, offered in English, Spanish, Vietnamese, Korean, Mandarin, Farsi, and Arabic. Orange County also offers informal mediation at no cost to parents who want to resolve a custody dispute without filing for a hearing at all, reachable at (657) 622-6196. That option is a practical way to keep a case out of contested status.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Are Los Angeles and Orange County recommending counties?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Neither is, and the distinction matters. In recommending counties, the child custody recommending counselor submits a written recommendation to the judge, and that recommendation frequently determines the outcome. Both Los Angeles and Orange County run confidential mediation instead. Orange County states the rule plainly: what parents discuss with the Court Mediator is not shared with anyone, including the court, with suspected child abuse as the exception. The practical consequence is that a failed mediation in either county leaves the judge hearing the custody evidence fresh, with no counselor's report on the file.&lt;/span&gt;&lt;/p&gt;

You file Form FL-141, the cover declaration confirming service, not the disclosures themselves. You cannot waive the preliminary disclosure under any circumstances. Once that hearing date exists, positions harden. Other frequent triggers include discovery of an account or income stream that was not disclosed, disagreement over the date of separation, a business or professional practice that requires valuation, unvested stock or deferred compensation, one spouse refusing to sign a settlement agreement after negotiating its terms, and a request for a domestic violence restraining order.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Can a contested case become uncontested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Yes, and most do. California dissolutions overwhelmingly settle rather than reach trial. Parties can convert a contested case at any point before judgment by signing a marital settlement agreement and submitting a judgment packet with Form FL-170 and Form FL-180. Filing a Response does not lock anyone into litigation, and neither does filing a Request for Order that later resolves by stipulation.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What does the difference cost?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

California's statewide first-paper fee is $435 for the petition and another $435 if a Response is filed, so a contested case starts around $870 in court costs against $435 for an uncontested one, or a single fee for a joint petition. A Request for Order adds roughly $60. Fee waivers are available for households at or below 125 percent of federal poverty guidelines and for recipients of Medi-Cal, CalWORKs, and similar benefits. The real cost difference is attorney time. Discovery, depositions, forensic accountants, custody evaluators, and trial preparation are what separate a four-figure uncontested divorce from a six-figure contested one.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Do I need a lawyer to finish an uncontested divorce?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Not legally. Both counties operate self-help centers and family law facilitators at no cost. The risk in doing it alone is a rejected judgment packet, which can leave a case sitting for months. The defects that come back most often are a missing Form FL-141, a settlement agreement that fails to dispose of every asset and debt, child support set below guideline without the findings Family Code section 4065 requires, retirement accounts divided without a qualified domestic relations order drafted before judgment, and documents that are unsigned or improperly notarized.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;What is the single biggest predictor of whether a case goes contested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Whether both spouses have the same picture of the marital estate. Cases where both parties know what exists tend to settle even when the relationship is bitter. Cases involving a closely held business, unvested equity compensation, separate property tracing, or one spouse who managed all the finances alone tend to go contested regardless of how amicable the parties feel at the start.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;How do I keep my case uncontested?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt;&lt;span&gt;Complete the preliminary disclosures early and thoroughly. Incomplete disclosure is the most common reason a settlement collapses later.&lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt;&lt;span&gt;Agree on the date of separation in writing before negotiating anything else.&lt;/span&gt;&lt;/li&gt;

&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;A contested divorce almost never begins as a fight about the thing people say it's about. Stand in the hallway outside a family law department at the Stanley Mosk Courthouse and ask two spouses what they're arguing over, and you'll hear "the house" or "custody." &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Sit through the hearing and something else surfaces. One of them doesn't believe the other's numbers. One of them is doing arithmetic in their head about what life looks like on half the income and coming up short. One spouse is angry about a betrayal and wants an apology that no judge has the authority to order.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;The distance between the stated dispute and the real one is what makes contested cases expensive, and it's what catches self-represented parties off guard. They prepare to argue about what they think is important, not what the law provides for.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;This is reflected in many ways. In a division of assets, a spouse is often focused on what they envision their post-marriage lifestyle to look like rather than the reality that half the fair value of the assets will not support that vision. In the case of spousal infidelity, the aggrieved spouse wants to punish the other for the hurt and betrayal and cannot understand why the Judge will not award more to punish the bad behavior. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Then they discover that family court runs on documents, deadlines, and evidence rules, and that being right about the marriage is not the same as being right in the case.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;This is a look at what's usually underneath a contested divorce in Los Angeles and Orange County, the errors people repeat when they represent themselves, and why the whole thing is genuinely difficult, not just tedious.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;The Issues Really at Stake in a Contested Divorce&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li&gt; &lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;One spouse knows the finances, and the other doesn't&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;One of the most reliable predictors of whether a divorce will be contested is whether one spouse knows and controls the marriage's finances. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;In a large share of marriages, one person manages the accounts, files the taxes, tracks the retirement plan, and understands the income sources or what is the actual value of a business or a retirement account. Because of a knowledge gap or an overabundance of trust, the other partner goes&amp;nbsp;along and signs where indicated. When the marriage ends, that arrangement converts overnight into a structural imbalance.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;California responds with mandatory disclosure. Both spouses must provide the other with a Schedule of Assets and Debts and an Income and Expense Declaration whether or not they get along, and the preliminary exchange cannot be waived under any circumstance. The rule exists precisely because the spouse with all the knowledge has no natural incentive to volunteer anything.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Often, the less-informed spouse doesn't know what to ask for, whether the information is accurate, or has no basis to recognize what constitutes a thin financial disclosure. While the failure to properly disclose can have major ramifications, it does happen. Sometimes the failure to properly disclose can be an innocent mistake, such as what the true valuation of property is; other times it can be more ominous, like the failure to disclose a cryptocurrency account.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;If a spouse believes the financial declarations are wrong, the remedy is to engage in discovery, which can include interrogatories (written questions and answers), production of documents, or deposition, which is questioning the spouse (or experts) under oath. All these paths can increase the cost and time of any divorce proceeding, but if you suspect the financials are not being reported accurately, they are absolutely necessary.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.2;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;The date the marriage ended&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;This is an issue that often surprises nonlawyers who do not understand why the date the marriage ended is important. California is a community property state, which means earnings and acquisitions during marriage generally belong to both spouses and everything after separation generally doesn't. This means the date of separation can be critically important in determining what is considered community property and what belongs to an individual spouse.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Consider this example. After a couple officially separates,&amp;nbsp; one of them wins the lottery for over ten million dollars. Is that community property? The official date of the separation becomes critically important to that determination. Another factor is whether the lottery ticket was purchased using community property funds (such as money from a joint bank account fed by active marital income earned before separation). If that is the case, the winnings or a portion of them may still be subject to community claims&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Even in more mundane circumstances, the date of separation can be an important and contested point of fact. For example, if you move the date by six months in either direction, you can move a bonus, a vesting tranche, a commission, or a down payment from one column to the other.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Couples rarely separate on a clean date. Somebody moves into the guest room. Somebody keeps a key. They go to a wedding together in October and stop speaking in December. Each spouse then reconstructs a timeline that favors their side, usually without meaning to distort anything. Two honest people can hold genuinely different memories of when it was over, and the difference between those memories is worth real money.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.2;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;Support numbers that feel arbitrary from the inside&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Child support in California runs on a statewide guideline formula driven by income and timeshare. Spousal support has a temporary calculation and then a longer list of statutory factors for anything post-judgment. On paper, this looks mechanical. It isn't, because the inputs are contestable.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Self-employment income can be characterized in several defensible ways. A parent who reduced hours to raise children may have income imputed based on earning capacity. Overtime that was reliable for a decade may or may not count going forward. Perquisites that reduce living expenses can be added back. Each of these is a legitimate argument, which means each is a place a case can stall.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;There's also a mechanical link people miss - timeshare feeds the child support formula. A custody schedule and a support number are not independent variables. That connection quietly raises the temperature on parenting disputes, because a parent who suspects the other is seeking additional overnights for financial reasons will fight harder over the schedule than the schedule alone would justify.&lt;/span&gt;&lt;/p&gt; 
&lt;ul&gt; 
 &lt;li style="line-height: 1.2;"&gt; &lt;p&gt;&lt;strong&gt;&lt;span&gt;Custody as a container for everything else&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Custody concerns or visitation rights are often among the most hotly contested issues in a divorce. Not living with or being able to see your children whenever you want can weigh heavily on any individual. These concerns are often exacerbated when your former spouse is introducing a new companion into the equation. A parent can feel erased by a divorce and totally replaced when a new person is dating their former spouse and interacting with their children.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;While some custody disputes are about genuine parenting concerns, many times it is about jealousy or the fear of being replaced in the eyes of their children&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Family court is a poor instrument for dealing with a spouse's personal jealousies or insecurities. It can also be extremely time-consuming and expensive. Judges must decide parenting plans in the child's best interest, not based on who behaved worse in the marriage. The National Center for State Courts, reviewing more than 147,000 domestic relations cases across eleven states, found that contested cases were more likely to involve minor children and more likely to generate ongoing court activity, and that roughly one in four family cases reopens after judgment. Cases involving children don't just get contested more often. They stay contested.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.2;"&gt;&lt;strong&gt;&lt;span&gt;Fear is an underlying factor driving contested divorces&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.6;"&gt;&lt;span&gt;Fear, whether financial or about new custodial arrangements, is the main driving force pushing contested divorces to become more expensive and last longer. A spouse who has never carried a mortgage alone, or who is fifty-eight and looking at a retirement account that's about to be cut in half, or who left the workforce in 2011, is not being unreasonable when they experience fear of a new beginning. The Federal Reserve's 2024 Survey of Household Economics and Decision-Making found that 37 percent of American adults could not cover a $400 emergency expense using cash or its equivalent. Those households are not walking into a property division negotiation from a position of calm; they are watching their life and future implode.&lt;/span&gt;&lt;/p&gt;

&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California's divorce statute doesn't use the words "contested" or "uncontested" anywhere. These two labels are used as a shorthand that lawyers, court clerks, and self-help centers often use to distinguish whether the two people getting a divorce can agree how to end their marriage or if a judge is needed to decide all or part of the terms of the divorce. It is also a shorthand that further identifies how long it will take to become divorced&amp;nbsp;and the costs that the parties can expect.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Since California has been a no-fault divorce state, the person filing for the divorce (i.e., petitioner) doesn't have to prove the other spouse did anything wrong; the standard language is &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-6/part-3/chapter-2/section-2310/"&gt;&lt;u&gt;&lt;span&gt;irreconcilable differences that have caused the irremediable breakdown of the marriage&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, a phrase broad enough to cover everything from a mutual decision to grow apart to a marriage that ended acrimoniously. Whether the case turns out to be contested has nothing to do with why the marriage is ending. It has to do with what happens after the petition is filed.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;What Makes a Divorce “Uncontested”&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;An uncontested divorce means the spouses agree, in writing, on every issue the court would otherwise have to decide. This includes how property and debts get divided, whether either spouse pays support and how much, and, if there are children, custody, visitation, and child support. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Once that agreement exists, the case moves seamlessly through the court system almost entirely on paper. Nobody argues in front of a judge as there is nothing to be argued about. A judge still reviews the paperwork and signs the judgment, but the parties themselves usually never set foot in a courtroom.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Timeframe for Completion of Uncontested Divorces&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;The timeframe it takes to complete an uncontested divorce is also shorter. There are two different tracts that an uncontested divorce can take. The easiest and shortest is a divorce that satisfies the requirements for a &lt;/span&gt;&lt;strong&gt;&lt;span&gt;summary dissolution,&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; and for those who don’t qualify, this is a process designed for short marriages with no children, minimal property, and debts under a set threshold, and it uses a simplified joint petition instead of the standard filing. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;To qualify for a &lt;/span&gt;&lt;a href="https://selfhelp.courts.ca.gov/divorce-california/summary-dissolution/qualifications"&gt;&lt;u&gt;&lt;span&gt;summary dissolution&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, you MUST meet ALL the following requirements:&lt;/span&gt;&lt;/p&gt; 
&lt;ol style="line-height: 1.5;"&gt; 
 &lt;li&gt;&lt;strong&gt;&lt;span&gt;Residency Requirements&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; - &lt;/span&gt;&lt;span style="background-color: #ffffff;"&gt;One of you must have lived in California for the last 6 months and in the county where you file for summary dissolution for the last 3 months. &lt;/span&gt;&lt;/li&gt; 
 &lt;li&gt; &lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;strong&gt;&lt;span&gt;Length of Marriage&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; - You have been married or have been registered partners for less than 5 years.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt;

 &lt;li&gt; &lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;strong&gt;&lt;span&gt;Assets –&lt;/span&gt;&lt;/strong&gt;&lt;span style="white-space-collapse: preserve;"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span&gt;Community Property&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; (What you own together) is less than $57,00 this includes money, stock, crypto, retirement accounts, and bank accounts. The value of cars is excluded. &lt;/span&gt;&lt;strong&gt;&lt;span&gt;Separate Property &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;(Property from before your marriage or after separation) is worth less than $57,000. This includes inheritance or personal gifts.&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
 &lt;li&gt; &lt;p style="line-height: 1.2; background-color: #ffffff;"&gt;&lt;strong&gt;&lt;span&gt;Agree to Terms of Divorce &lt;/span&gt;&lt;/strong&gt;&lt;span&gt;– You must both agree to&lt;/span&gt;&lt;/p&gt; &lt;/li&gt; 
&lt;/ol&gt; 
&lt;ul style="line-height: 1.5;"&gt; 
 &lt;li style="color: #1b1b1b;"&gt;&lt;span style="color: #1b1b1b;"&gt;That you want to end the marriage or domestic partnership&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #1b1b1b;"&gt;&lt;span style="color: #1b1b1b;"&gt;That neither of you will ever get spousal support&lt;/span&gt;&lt;/li&gt; 
 &lt;li style="color: #1b1b1b;"&gt;&lt;span style="color: #1b1b1b;"&gt;How you will split up any property and debts&lt;/span&gt;&lt;/li&gt; 
&lt;/ul&gt; 
&lt;p style="line-height: 1.5; background-color: #ffffff;"&gt;&lt;span style="color: #1b1b1b;"&gt;If you meet all of these requirements, you merely file the &lt;/span&gt;&lt;a href="https://courts.ca.gov/sites/default/files/courts/default/2024-11/fl800.pdf"&gt;&lt;u&gt;&lt;span&gt;Joint Petition for Summary Dissolution (FL-800)&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;,&lt;span style="color: #1b1b1b;"&gt; wait the mandatory 6-month waiting period, and the marriage will be dissolved. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Most divorces don't qualify, since the asset and marriage-length limits are strict, but for the couples who do fit inside them, it's the fastest and cheapest route the state offers.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;If you do not qualify for a Summary Dissolution, you can still obtain an uncontested divorce if both parties agree on all on every issue the court would otherwise have to decide.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;An uncontested divorce that does not qualify for a summary dissolution can begin by one of two methods:&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Traditional / Separate Filing:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; One spouse will file as the Petitioner and serve the other spouse, who then files a response or a written appearance indicating agreement, often accompanied by a signed Marital Settlement Agreement. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;Joint Petition:&lt;/span&gt;&lt;/strong&gt;&lt;span&gt; Both spouses file together as Co-Petitioners from the start, signing the same initial paperwork. In California, &lt;/span&gt;&lt;a href="https://selfhelp.courts.ca.gov/divorce/joint-petition"&gt;&lt;span&gt;Joint Petition&lt;/span&gt;&lt;/a&gt;&lt;span&gt; is an available option for starting an uncontested case cooperatively without formal service of process. The advantage of filing a joint petition is that it can make the &lt;/span&gt;&lt;span style="color: #1b1b1b;"&gt;process feel calmer and more cooperative as you work together on the issues&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Once filed, an uncontested divorce does not mean that the process is complete and that there are not additional decisions and paperwork.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;California requires both spouses to exchange a preliminary declaration of disclosure, a sworn accounting of every asset, debt, income source, and tax return, &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-6/part-1/chapter-9/section-2104/"&gt;&lt;u&gt;&lt;span&gt;under Family Code section 2104&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, regardless of how amicable the split is. A final declaration of disclosure is also required &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-6/part-1/chapter-9/section-2105/"&gt;&lt;u&gt;&lt;span&gt;under section 2105&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, although both spouses can jointly waive it if they've already exchanged full financial information and both sides sign off under penalty of perjury. Skipping disclosure isn't an option just because nobody's fighting; the law treats full financial transparency as a precondition of any dissolution, agreed or not.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;strong&gt;&lt;span&gt;What Makes a Divorce Contested&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;A contested divorce does not mean that the parties are necessarily hostile, although there are many occasions where this is the case. What the term “contested” refers to is that the parties cannot agree on the terms of the divorce. In most cases, these types of disputes revolve around issues of property valuation, support, or child custody/visitation issues. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;If the spouses are in total agreement of all the underlying terms of a divorce, but disagree about just one issue, it is a contested divorce. One unresolved question is enough to shift the entire case out of the paper-only track and into active litigation on that issue, even if everything else was settled amicably.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Once a case is contested, the entire divorce process changes. Once a divorce is contested, the direction it takes often is driven by the assets in dispute or if there are minor children involved.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;At the outset, either spouse can file a Request for a temporary order asking a judge for temporary support, use of the house, or a custody schedule while the case is pending. These are more than perfunctory decisions as they often serve as the framework for final post-divorce orders.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;To get a firm understanding of the key issues, formal discovery is often necessary. These can involve written questions, document demands, and sometimes depositions. &lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;If the dispute involves minor children, the law doesn't leave it to the parties or their attorneys to work out alone: &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-8/part-2/chapter-11/article-2/section-3170/"&gt;&lt;u&gt;&lt;span&gt;Family Code section 3170&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt; requires the court to refer any contested custody or visitation issue to mediation through the court's family court services division before a judge will hear it. In practice, that means a parenting dispute in Los Angeles or Orange County goes through a mediator employed by the court before it goes anywhere near a bench.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;In a contested custody divorce, whether it settles in mediation or ends up in front of a judge, is the child's best interest, defined in the Family Code as a non-exhaustive list of factors &lt;/span&gt;&lt;a href="https://law.justia.com/codes/california/code-fam/division-8/part-1/chapter-2/section-3011/"&gt;&lt;u&gt;&lt;span&gt;under section 3011&lt;/span&gt;&lt;/u&gt;&lt;/a&gt;&lt;span&gt;, starting with the health, safety, and welfare of the child and extending to any history of abuse, substance use, and the nature of each parent's existing relationship with the child. Because the standard is deliberately broad rather than formulaic, two parents can each have a reasonable case, which is exactly why custody disputes are disproportionately represented among the small share of family law matters that end up needing a judge's decision rather than a mediated agreement.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5;"&gt;&lt;span&gt;Property and support disputes don't carry the same mandatory mediation requirement, but courts push hard toward settlement anyway, typically through mandatory settlement conferences scheduled before a trial date is ever set. Trial exists as an option, and family court judges do hold them, but it's the last stop on a long road, not the default destination for a case just because someone checked "contested" on an intake form.&lt;/span&gt;&lt;/p&gt; 
&lt;p style="line-height: 1.5; background-color: #ffffff;"&gt;&lt;strong&gt;&lt;span style="color: #101012;"&gt;Summary: Special Considerations for Divorce in California – Uncontested vs. Contested&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
